The Mississippi Department of Education (MDE), Office of Special Education (OSE) has developed Procedure Manuals (Volumes I, II, III, IV, and V) for State Board Policy Chapter 74, Rule 74.19, State Policies Regarding Children with Disabilities under the Individuals with Disabilities Education Act Amendments of 2004 (IDEA 2004).
The procedures for implementation of State Board Policy Chapter 74, Rule 74.19 consist of multiple volumes and are intended to assist public agencies as they implement State Board Policy Chapter 74, Rule 74.19, which are the State Policies Regarding Children with Disabilities under the Individuals with Disabilities Education Act Amendments of 2004 (IDEA 2004). The Procedure Manuals do not replace the State Policies. They represent a collection of resources that can be used by public agencies to implement the requirements of the State Policies and IDEA.
The Procedure Manuals include information about the requirements of IDEA and State Board Policy Chapter 74, Rule 74.19 and recommendations from the MDE/OSE and the Division of Instructional Support. Information included in the Procedure Manuals represents guidance on best practices as determined by research and professional practice.
Specific directives or requirements of IDEA and/or State Board Policy are referenced in the Procedure Manuals and include the words must or may not in the statements. Statements that include the words should or may in the Procedure Manuals reflect recommendations and best practice guidance and are not mandates of the MDE/OSE.
The forms included in the Procedure Manuals are not required forms, rather they are suggested or recommended forms designed to provide public agencies with the appropriate forms for their use in implementing and documenting the requirements of IDEA and State Board Policy Chapter 74, Rule 74.19. (Note: The only required forms included in the Procedure Manuals are the Individualized Educational Program (IEP) form and the Extended School Year (ESY) Fact Sheet.)
